CAP COUNT FOR H-2B NONIMMIGRANTS
|
|
The H-2B non-agricultural temporary worker program was created by Congress to allow U.S. employers to
bring noncitizens to the United States to fill temporary non-agricultural jobs. Under the Immigration and Nationality Act (INA), as amended, there is a statutory numerical limit, or
“cap,” on the total number of noncitizens who may receive an H-2B visa, or otherwise be granted H-2B
status, during a fiscal year.

PRACTICE ALERT: UPDATES ON E AND L DERIVATIVE SPOUSE ADMISSION CODES
|
|
AILA’s CBP Liaison Committee has received updated information from Systems Enforcement Analysis and
Review (SEAR). SEAR confirmed that the implementation of the new Codes of Admission went live on
January 31, 2022. As of this date, no dependent of an E or L visa can be admitted by the category alone.

PROGRAM OFFERS FOREIGN ENTREPRENEURS THE OPPORTUNITY TO WORK IN THE UNITED STATES TO DEVELOP A STARTUP
|
|
The International Entrepreneur Parole program, which was relaunched in May 2021, provides foreign start-up entrepreneurs (founders/ C-Suite) the opportunity to work in the United States to develop a promising start-up entity with significant potential for rapid business growth and job creation.

AILA WELCOMES LEGISLATION TO CREATE INDEPENDENT IMMIGRATION COURT
|
|
The American Immigration Lawyers Association (AILA) welcomed newly introduced
legislation that would create an independent immigration court system. The Real Courts, Rule of Law Act of
2022 was introduced by Representatives Zoe Lofgren (D-CA), Jerrold Nadler (D-NY), and Hank Johnson (DGA), following two hearings on this issue over the past few years.

APPLICATION PROCESSING BACK LOG REDUCTION FY 2022
|
|
The “Application Processing” report outlines the expenditure plan for the $250 million provided by Congress to U.S. Citizenship and Immigration Services (USCIS) to support application processing, which includes the reduction of backlogs within asylum, field, and service center offices, and to support the refugee program that is included in section 132 of the Continuing Appropriations Act, 2022 (P.L. 117-43). USCIS also included a spending plan for the full $345 million requested in the FY 2022 President’s Budget to show the comparison.

The Biden-Harris Administration believes that one of America’s greatest strengths is the
ability to attract global talent to strengthen the United States economy and technological competitiveness,
and benefit working people and communities all across the country.

DIGITAL NOMADS – IMMIGRATION AND LABOR ASPECTS TO BE CONSIDERED
|
|
After the covid´s restrictions, companies had to deal with this new modality of working remotely. In this sense, several countries opened their borders to the new modality of “digital nomads” who want to temporarily reside in these places.
There are 25 countries that have migratory legislation of digital nomads in force.
